API logo usage requirements

API LOGO USAGE REQUIREMENTS
 
These API Logo Usage Requirements are part of the API License Agreement. Your use of the API Logos must comply with these requirements. Capitalized terms that are not defined herein shall have the meaning given to them in the API License Agreement.
 
You must display the API Logos in the form provided. You may not modify or alter the API Logos including size, proportions, colors, elements, type or in any other respect, without the prior written approval of eBay. All of Your materials bearing the API Logos shall carry the following notice: "eBay and the eBay Logo are trademarks of eBay Inc.", or upon written agreement by eBay the following notice: "Designated trademarks and brands are the property of their respective owners." The eBay Logos provided to You contain the ® or TM symbol, and that symbol should never be deleted. eBay reserves the right to approve in writing all of Your materials incorporating the API Logos and eBay Content in advance of their use. eBay may withhold its approval of such materials in eBay’s sole discretion. In the event eBay requests to review such materials, You shall give eBay no less than fifteen (15) business days to review and approve said materials. eBay shall have an opportunity to review and approve (or disapprove) in writing in advance of their use the revised versions of any such materials reflecting changes as may be requested by eBay, on no less than two (2) business days notice to eBay. eBay may immediately terminate Your license to use the API Logos upon notice to You at which time You will immediately cease any and all use of the API Logos
 
Additional Requirements:
 
1. Purpose.
 
The goal of these requirements is to create a consistent front to everyone—customers, prospects, vendors, the media, or investors—throughout the course of business. This unified approach will help:
 
(a) Build a consistent visual image that lets your customers know they are accessing a trusted, vibrant, global marketplace through an application that was developed by a certified developer.
 
(b) Gain market impact and recognition for the program and its participants through consistent presentation.
 
(c) Protect eBay's trademarks.
 
Use of API logos does not imply endorsement or sponsorship of your application by eBay.
 
2. Logo Sizes.
 
Right Now on eBay Logo. The Right Now on eBay Logo is available in four sizes in English, and in three sizes for seven other local language eBay sites (Germany, France, Italy, Spain, Netherlands, China, and Taiwan). The English versions are all available via the GeteBayDetails API call for developers using Trading Web Services. The international versions and versions for developers using Shopping Web Services can be downloaded here. Your application must be built to display the Right Now on eBay Logo if you intend to display any eBay Content. A sample of the Right Now on eBay Logo is shown below.”

eBay Compatible Application Logo. The eBay Compatible Application Logo will be provided after your application has been built using the eBay API and certified.
 
The eBay Compatible Application Logo will be provided in an EPS format and can be resized as needed, but in no event shall the logo be smaller that .5” in length. The logo should scale proportionally. A sample of the eBay Compatible Application Logo is shown below.
 
 
Note: If you are eligible to use the eBay Compatible Application Logo, but in your reasonable judgment it is too large to use on your web site, even at the smallest specified size of 0.5” (36 pixels) in length, then you may use the eBay Logo in lieu. The eBay Logo will be provided after you have been determined to be eligible to use the eBay Compatible Application Logo. The eBay logo will be provided in EPS format and can be resized as needed, but in no event shall the eBay Logo be smaller than 0.5” (36 pixels) in length. The eBay logo should scale proportionally. A sample of the eBay Logo is shown below.
 
 
eBay Developer Program Member Logo. The eBay Developer Program Member Logo can be used to indicate participation in eBay’s developer program. The logo must be used in accordance with the guidelines located at http://developer.ebay.com/DevProgram/LogoGuidelines.pdf A sample of the eBay Developer Program Member Logo is shown below.
 
 
3. Required Usage of the Right Now on eBay logo
 
(a) The logo must be displayed whenever the application publicly displays data obtained via eBay’s API.
 
(b) The logo and eBay content must be displayed in such a way that the eBay Content is clearly identified.
 
(c) For both web-based and desktop applications, the logo should appear near and above eBay data that is being displayed. For web-based applications, the preferred placement is above the fold if the data appears in the upper left-hand part of the web page. The logo should appear prominently but not detract from your product.
 
(d)The logo must be obtained using the GetLogoURL function call. In order to ensure that your application is using the most current logo, you can cache it for at most 24 hours.
 
(e) The logo must be displayed at the sizes returned by the GetLogoURL function call. No alterations will be allowed.
 
(f) The logo must link to the following URL, or some such other URL chosen by eBay in eBay’s sole discretion: http://www.ebay.com/api/index.html.
 
4. Restrictions on Usage of the Right Now on eBay Logo
 
(a)The logo must not be used in connection with non-eBay content.
 
(b) The logo must not be used as part of text.
 
(c) The logo must not be used as any part of another logo as a design element.
 
(d) The logo must not be condensed, extended, skewed, distorted, manipulated, modified, rotated, scaled or otherwise altered.
 
(e) If eBay data culled via the eBay API is being displayed during the checkout process, the logo must appear at the beginning of the checkout process but must not appear during a credit card collection or fulfillment piece.
 
5. Required Usage of the eBay Compatible Application logo
 
(a) The Compatible Application Logo can be displayed to promote Your Applications once it has passed Certification.
 
(b) The Compatible Application Logo must be displayed in conjunction with applications that have been certified.
 
(c) The logo must link to the following URL, or some such other URL chosen by eBay in eBay’s sole discretion: http://developer.ebay.com/join/benefits/logo/
 
(d)The logo must be used in accordance with the guidelines located at http://developer.ebay.com/DevProgram/LogoGuidelines.pdf
 
6. Restrictions on Usage of the Compatible Application Logo
 
(a) The logo must not be used as part of text.
 
(b) The logo must not be used as any part of another logo as a design element.
 
(c) The logo must not be condensed, extended, skewed, distorted, manipulated, modified, rotated, scaled or otherwise altered.
 
7. Required Usage of the eBay Logo
 
(a) The eBay logo must not be used smaller than .5 inches or 36 pixels in length
 
(b) If at least enough space is available to accommodate a logo of 108 x 45 pixels the “Right Now on eBay”, “eBay Compatible Applications” or “eBay Developers Program Member” logos should be used
 
(c) The eBay logo shall be used in electronic format only
 
8. Restrictions on Usage of the eBay Logo
 
(a) The eBay logo must not be used as part of text
 
(b) The eBay logo must not be used as part of another logo or design element
 
(c) Do not display the logo in a box or other shape
 
(d) Do not alter the shape or coloration of the logo
 
(e) Do not use the logo as an active link
 
9. Notification of Adverse Use
 
You must promptly notify eBay in writing of any adverse use by a third party of any eBay API Mark or name confusingly similar to any eBay API Mark and will to take no action of any kind with respect thereto except with the prior written authorization of eBay. You will provide full cooperation with any legal or equitable action by eBay to protect its right, title and interest in and of the eBay API Marks.
 
10. Infringement Proceedings
 
In the event of infringement of any eBay API Mark by a third party, eBay shall have the sole right in its discretion to initiate and conduct proceedings (including notifications to customs or other government officials objecting to the importation of infringing goods) against the infringing party, to initiate and conduct negotiations with respect thereto, including, but not limited to settlement discussions and to retain any damages recovered in such proceedings.
 
11. Quality Control & Review Process
 
(a) Product and Services Quality. You may use and apply any eBay API Mark only to the products and other materials permitted by your agreement only so long as the quality of those products and other materials meet eBay’s high standard of quality consistent with the level of quality reflected in eBay’s own services and products. Without limiting the foregoing and by way of example only:
 
(i) No eBay API Mark may be used on or in connection with any material that is pornographic, associated with the sale of cigarettes, firearms or alcohol, or is morally offensive or otherwise objectionable in light of eBay’s reputation for providing a safe online environment for trading;
 
(ii) No eBay API Mark may be used on or in connection with any material that libels or defames eBay or any of its vendors or customers;
 
(iii) No eBay API Mark may be used on or in connection with any material that violates any state, federal or foreign law or regulation.
 
(b) Prior Submission of Samples. eBay reserves the right to require you to submit samples of any and all materials bearing the eBay API Mark to eBay for review and approval prior to the distribution of such materials. Unless otherwise provided for in your written agreement with eBay, eBay shall have the right to make reasonable objections to any such sample within fifteen (15) days of its receipt thereof on the grounds that eBay believes in good faith that the use and/or distribution of such materials by you will be damaging to the recognition value or reputation for quality associated with the eBay Logo, or the materials do not meet the requirements of this Policy or your written agreement with eBay. In the event of such an objection, you shall modify the materials in accordance with the objection of eBay prior to the distribution of the materials.
 
12. Termination
 
Unless otherwise provided for in your written agreement with eBay, should eBay notify you that any of your uses of any eBay API Mark do not meet the requirements set forth in this Policy or your written agreement with eBay, you must correct all misuses of such eBay API Mark immediately. If the misuse of the eBay API Mark is not corrected immediately, your license to use the eBay API Mark shall terminate. In the event of termination of this Agreement for any reason, you agree to discontinue immediately all use of any eBay API Mark and to promptly destroy or return to the place designated by eBay all materials that bear the eBay API Mark.
 
13. Other Terms and Conditions
 
In the event of any breach of the terms and conditions set forth in this Policy or your written agreement with eBay, you agree that eBay shall be entitled to seek injunctive relief in addition to other available remedies.
 
14. Advertising Guidelines
 
The eBay Site is a "person to person trading site" or an "online trading site." The eBay Site should never be referred to as an "auction site." Additionally, because your listings on the eBay Site are not "auctions" as that term is commonly understood, do not refer to your listings as "auctions". Suitable alternatives include: "items", "listings" and auction-style listings." Please do not refer to eBay as a "partner." Your relationship with eBay may be characterized as an "agreement."
